Delivery:
Photos/ 3D Tours will be delivered by 2 PM the day after shooting, unless otherwise agreed. Video will be delivered by 6 PM three days after shooting, unless otherwise agreed. Rush Delivery fees will apply if photos need to be delivered by 10 AM next day and or Video need to be delivered by 2 PM second day. No deliveries on Sundays – Photos / 3D Tours shot on a Saturday and Videos shot on a Thursday will be delivered the following Monday.
Rescheduling / Cancellation:
A photo/video shoot may be rescheduled due to inclement weather. Elevato Visuals is not able to fly the drone in heavy rain and any aerial footage may need to be shot on a different day due to possible rain factors.
Day of Shooting:
The property must be ready for shooting. If the property is not ready for shooting upon arrival, a fee of $100 will apply. Elevato Visuals may re-place objects if it is better suited for shooting. Re-placed objects will be returned to their original places after shooting. Elevato Visuals is not responsible for any cleaning and tidying up of the property.
Final Product:
Elevato Visuals will make its best efforts to showcase the property but is not responsible for the outcome of the sale of the property.
Copyrights and License:
Elevato Visuals owns the rights to all produced media. Client will be granted a license to use the final media for a time-period of one listing on the Northwest MLS and other listing platforms.
For airbnb / rental / designer / architectural photos, client will be granted a license to use the final media for an unlimited time-period, with the extended license fee.
Marketing:
Client has the right to use media for marketing purposes during the listing period. If media is used for clients marketing purposes after the listing period, Elevato Visuals will need to be credited. Elevato Visuals has the right to use any media for marketing purposes.
Additional License:
Client may share final media with homeowners. Elevato Visuals will need to provide an additional license for builders, contractors, stagers and designers if they wish to use the media provided for marketing purposes. An additional fee may apply.
Duration:
3D Tours will be active until the sale of the property is final and/ or the listing expires.
Damage to The Property:
Elevato Visuals will repair any damage caused to the property during shooting.
Governing Law:
This Agreement shall be governed by the laws of the State of Washington.
Severability:
In the event that any provision of this Agreement shall be declared to be invalid, illegal or unenforceable, such provision shall survive to the extent it is not so declared, and the validity, legality and enforceability of the other provisions hereof shall not in any way be affected or impaired thereby, unless such action would substantially impair the benefits to any party of the remaining provisions of this Agreement.
Attorney’s Fees:
In the event of any litigation arising out of this Agreement, the prevailing party shall be entitled to recover actual costs and reasonable attorney’s fees and costs.
